Special Counsel Jack Smith is asking a federal judge to issue a partial gag order restricting Donald Trump from falsely claiming that FBI agents who searched his Mar-a-Lago estate in 2022 were part of a plot to assassinate him.
Smith’s team asked Judge Aileen Cannon to “take steps immediately to halt this dangerous campaign to smear law enforcement.”
Trump has posted repeatedly on social media that the FBI was “locked & loaded ready to take me out & put my family in danger.”
His comments were based on a filing in his criminal case on charges that he withheld government-owned classified documents and obstructed efforts to retrieve them. The filing was a standard form that outlined the Justice Department’s use-of-force policy in the search. It was amplified by right-wing media, including Fox News’ Maria Bartiromo, but refuted by other outlets, including Fox News White House correspondent Jacqui Heinrich, who reported that...

Donald Trump likes to tell anyone who will listen that he’s absolutely convinced he will win his 2024 rematch against President Joe Biden. And, according to people who’ve spoken to the ex-president about this, Trump also seems convinced that if he wins another four years in the White House, state prosecutors will still be waiting for him on the other side of his term — ready to put him on trial, or even in prison, just as they are now.
To avoid such risks, the former and perhaps future president...

Judge Juan Merchan scolded lawyer Robert Costello for his behavior during former President Donald Trump’s New York hush money trial.
On Monday afternoon, Merchan cleared out his Manhattan courtroom of jurors, spectators and the press so that he could dress down at Costello, who was there as a key defense witness for Trump, after he made a frustrated comment about the judge’s rulings, according to a court transcript.
The transcript also mentioned that the lawyer commented under his breath and rolled his eyes.
The judge told Costello that his behavior during testimony was “contemptuous.” Costello frequently angered the judge, in part by speaking after objections were sustained.
“Geez,” the lawyer muttered after Merchan sustained several prosecution objections to his testimony.
He also called the whole exercise “ridiculous.”

Rudy Giuliani spent most of the past month successfully evading an indictment for a 2020 false elector criminal case in Arizona — until officials tracked him down at his 80th birthday party.
CNN reported Giuliani was celebrating the occasion in Palm Beach, Florida, on Friday when he was served the papers. Prior to being handed the lawsuit, he made a post on X, formerly Twitter, mocking Arizona authorities for failing to track him down.

GOP Rep. Marjorie Taylor Greene Accuses House Speaker Mike Johnson Of Being ‘Owned By The Democrats’
Rep. Marjorie Taylor Greene (R-Georgia) has accused House Speaker Mike Johnson of being “owned by the Democrats” in a new interview.
Greene’s allegations come as a response to Johnson’s perceived unwillingness to “defund Jack Smith,” the special counsel who has brought two indictments against former President Donald Trump.
“Mike Johnson is owned by the Democrats, and that proved to me to be right again,” Greene stated in an interview on Fox News’ Maria Bartiromo. She went on to claim that it was not Republicans who saved Johnson from her “motion to vacate” his position, but instead Democrats, such as former House Speaker Nancy Pelosi (D-California) and former House Judiciary Committee Chair Jerry Nadler (D-New York).
“When you have Nancy Pelosi, who was Speaker of the House when they impeached President Trump twice, and you have Jerry Nadler, who was chairman of the Judiciary Committee that led the impeachment against President Trump,...

Updated: House Speaker Mike Johnson is the latest figure to lend his support to Donald Trump and his claim that the New York hush money trial is a “sham.”
Johnson was in the background as Trump made his regular morning statement to the press in the hallway just outside the courtroom, and the speaker nodded at the former president as he made his way in.
Also joining Trump were other supporters, including Vivek Ramaswamy, Rep. Byron Donalds (R-fl) and North Dakota Governor Doug Burgum. Ramaswamy and Burgum are among a number of vice presidential contenders to visit the courthouse to show their fealty to Trump, on trial for allegedly falsifying business records to cover up a hush money payment to porn star Stormy Daniels.

According to some in his inner circle, Donald Trump’s most effective and not-so-secret weapon in his 2024 effort to reclaim the White House is a federal judge he appointed in Florida.
Judge Aileen Cannon is presiding over one of Trump’s two federal criminal cases — the classified documents case in the Southern District of Florida. In August 2022, the FBI raided Trump’s Florida club and estate, Mar-a-Lago, following his sustained refusal to return to the government a trove of classified documents he was hoarding at the club. Rudy Giuliani’s refusal to stop pushing election conspiracies has already cost him plenty, and on Friday the former New York City mayor and Trump sycophant was dealt another blow — this time through the cancellation of his radio program.
Wabc, the radio station that hosted Giuliani’s program Rudy Giuliani, suspended the host and canceled the show after he repeatedly refused to comply with a station policy barring on-air claims disputing the legitimacy of the 2020 election.

Donald Trump‘s trial start date over his mishandling of classified documents has been pushed back thanks to a Florida judge overseeing the case. On Tuesday, District Judge Aileen M. Cannon indefinitely postponed the trial, previously scheduled for May 20, increasing the odds that Trump’s hush money trial in New York may be the only one he faces prior to the election in November.
In her order Tuesday, Cannon made it clear that she intends to resolve multiple pending pre-trial issues that both parties will have to meet before a new trial date is set.

Donald Trump unleashed his anger against President Joe Biden at a closed door GOP fundraiser on Saturday where he made a speech that was “frustrated and often obscene,” according to The New York Times. In a Truth Social post the following morning, Trump attacked Biden as “a very dishonest man, a Manchurian Candidate” and predicted “World War Three, and everything else!”
“These people are running a Gestapo administration,” Trump said of Biden at the fundraiser hosted at his Mar-a-Lago property in Florida, audio of which was obtained by the Times.

Supreme Court oral arguments were made for social media. Social media was not made to make Supreme Court arguments persuasive or even understandable.
The court’s latest Donald Trump case is a perfect illustration. The justices on this court are relatively young. Their questions are clear and direct, and they all are engaged, respectful, and fair. If you listen from start to finish, you can’t help but think this is the most deliberate and serious branch of the three-ring circus that is Washington, D.C.

Donald Trump reportedly did not expect to win the presidency in 2016, which isn’t surprising considering how ill-prepared he and his team were to take control of the country. He appointed established conservatives to key positions before learning some had personal principles that extended beyond indulging the president’s ego. Trump wreaked havoc on the United States for four years, but the damage might have been even greater if he wasn’t battling career public servants who tried to check his impulses, or if he wasn’t such a political neophyte.

During a hearing this week, most of the justices on the U.S. Supreme Court appeared skeptical about offering blanket immunity to a former president, which would keep them from being prosecuted for criminal acts.
On Sunday, Senate Minority Leader Mitch McConnell reiterated that former President Donald Trump should be “held accountable” when asked about the court hearing.
On Meet the Press, host Kristin Welker asked McConnell: “Just to be clear, you said former presidents are not immune from being held accountable. Do you stand by those comments?
“That was my view, but I don’t make those decisions,” McConnell responded.
“But do you stand by those comments?” Welker pressed. “Yeah, that’s my view. But my view is my view. The court is going to decide this,” McConnell said.

Update: Supreme Court justices expressed skepticism of Donald Trump’s argument that presidents enjoy broad immunity, but they wrestled with which certain official acts could be shielded from prosecution and which would not.
There were some suggestions of sending the case base to lower courts to decide, on an individual basis, which of the charges against Trump could be deemed as private acts and subject to criminal liability. That is a prospect that could lead to further delay in Trump’s election conspiracy case, perhaps until after the 2024 election.
A number of the justices expressed concerns that their decision in the case would impact future presidents after they leave office and the extent to which they could be subject to criminal prosecution. Justice Samuel Alito hypothesized about political rivals being prosecuted and “a cycle that destabilizes the functioning of our country.”

Judge Juan Merchan issued a warning to former President Donald Trump, saying that he would be arrested if he disrupted or skipped his hush money trial.
On April 15, the day this warning was issued, Trump’s attorney, Todd Blanche, claimed that the former president wanted to be present for trial proceedings. Such proceedings include sidebar conferences during the trial and voir dire, the initial examination of a witness or a juror.
In response, Merchan warned that Trump’s presence may also pose logistical challenges involving the Secret Service.

This article contains massive spoilers for Civil War.
Barely in cinemas for 24 hours, the already most debated aspect of Alex Garland’s Civil War has been its ambiguity. Despite being a picture centered around journalists, Garland’s vision of social collapse in the United States remains curiously spartan when it comes to background details. It suggests polarization has become so extreme that Americans are dying by the tens of thousands (if not more). Yet by design, Garland does not explain the root cause of that polarization or much else of what led to the last bedraggled days of an unnamed president (Nick Offerman) on the verge of being overthrown in a hail of gunfire.
Some have criticized this creative decision—to which Garland himself gave us his counterpoint—while others have struggled to make sense of it. Does the film have a political point-of-view, and if so does it offer...

Brian Butler, a former valet at Mar-a-Lago, has come forward to share his role in the transportation of banker’s boxes filled with classified information on behalf of Donald Trump‘s private club.
Identified as “Trump Employee 5” in Trump’s classified documents indictment, Butler shared that he moved the material in June 2022, just before he left his employment with Trump.
In a recent on-camera interview with CNN, Butler confirmed that he coordinated the activity with property manager Carlos De Oliviera and Trump aide Waltine “Walt” Nauta, as stated in the indictment filed by prosecutors in July of the same year. Butler had already spoken with federal investigators prior to the charges being filed by Special Counsel Jack Smith‘s team.
Butler recalled the message he received from Nauta on June 3, 2022, which requested the use of the Cadillac Escalade, part of the car service fleet Butler operated to transport guests to the club.

The start date for the Florida trial on Donald Trump’s mishandling of classified documents is in the hands of a judge the former president appointed to the federal circuit.
The trial, currently scheduled to begin May 20, is likely to be delayed after prosecutors and defense attorneys met at a federal courthouse in Fort Pierce, Florida, on Friday.
U.S. District Judge Aileen Cannon, appointed by Trump to the Southern District of Florida in 2020, said the timeline proposed by prosecutors for a trial this summer was “unrealistic.”

Special Counsel Jack Smith is urging for the protection of witnesses in the Mar-a-Lago classified documents case against former President Donald Trump.
FBI agents searched Trump’s residence in August 2022 in Palm Beach, Florida. Authorities discovered thousands of classified documents illegally held by Trump with the intent of hiding them.
A request by Trump’s lawyers for more documents could threaten to reveal the identities of more witnesses in the case. Those who have already been identified have faced harassment and significant threats to their safety, prosecutors state. FBI agents, judges and prosecutors have also been threatened.
Outing the identities of more witnesses who are prepared to testify against Trump poses several risks to the case. In the past, two potential witnesses switched lawyers after Smith brought up conflicts of interest. Under the new lawyer, one witness revealed new information to the special counsel, leading to a new superseding indictment against Trump.

Federal prosecutors are investigating threats to possible government witnesses in the confidential documents case against Donald Trump, according to court documents filed this week.
On Wednesday, special counsel Jack Smith filed a motion to submit a sealed document that “describes in some detail” threats made against witnesses over social media and an ongoing federal investigation into the threats. The motion argued sharing all the details “risks disrupting the investigation.”

The FBI failed to investigate a secret room and closet in Donald Trump‘s Mar-a-Lago resort when searching for sensitive documents, according to several witnesses.
Trump’s resort was raided by federal officers on August 8, 2022, when they executed a search warrant. They then searched the premises for any potentially classified material and they found 11,000 documents and took away at least 100 classified documents.
However, a team working for Special Counsel Jack Smith has since spoken to several witnesses claiming that a locked cabinet and a secret room had not been examined during the raid.
According to sources who had spoken to ABC News, investigators involved in this case have since asserted that Trump replaced a lock on the cabinet while searches were in progress while the “hidden room,” which is believed to be connected to the former president’s bedroom, also reportedly went unchecked.

Donald Trump’s bid for presidential immunity in his federal election interference case has been summarily rejected by D.C.’s Federal Court of Appeals — and the issue could be headed to the Supreme Court.
In a ruling issued Tuesday, the three-judge panel, which heard oral arguments in the case last month, unanimously determined that Trump is not shielded from prosecution for potential crimes committed in office related to the subversion of the 2020 election.

Former Vice President Mike Pence said during a pro-life summit that he wants the abortion pill, known as Mifepristone, to be taken off the market immediately.
Pence appeared at the Students for Life of America (Sfla) National Pro-Life Summit this month.
He sat down for a Q&a with Sfla President Kristan Hawkins at the beginning of the event.
Pence was asked what a pro-life president should initially do if elected in 2024.
“I think that our new president should direct the new attorney general to suspend all efforts to harass pro-life activists in America,” Pence said. “And frankly I think they should pull the abortion pill off the market.”
“I believe those are two urgent causes and I think we have to step forward and make that happen on day one,” Pence said.

Former President Donald Trump warned that violence would ensue if any of the criminal charges resulted in his conviction.
Without presenting any evidence, Trump declared that he was being prosecuted due to polls showing that he was ahead of President Joe Biden. He warned that if these charges end up harming his candidacy, then the country could descend into chaos.
“I think they feel this is the way they’re going to try and win, and that’s not the way it goes,” the former president stated after a court hearing in Washington, D.C.
“It’ll be bedlam in the country. It’s a very bad thing. It’s a very bad precedent. As we said, it’s the opening of a Pandora’s box,” he added.
On January 5, Biden condemned Trump for refusing to reject violence.

Donald Trump Posts Holiday Greeting To Biden & Prosecutors: ‘May They Rot In Hell. Merry Christmas.’
In an unexpected Christmas message posted to Truth Social, former President Donald Trump raged against various individuals whom he believes are “looking to destroy” the nation.
The messages, disseminated throughout Monday, targeted President Joe Biden, Special Counsel Jack Smith, world leaders and proponents of electric cars.
Trump’s Truth Social post, shared at 2:38 p.m. Est, began with a holiday greeting tinged with accusatory language: “Merry Christmas to all, including Crooked Joe Biden’s Only Hope, Deranged Jack Smith.”
Trump has consistently characterized Smith, who currently spearheads the prosecution against Trump for his alleged role in the 2020 election and the January 6 Capitol attack, as mentally deranged. It should be noted that the Supreme Court recently rejected Smith’s plea for an immediate ruling on Trump’s assertion of legal immunity, and cited the former president’s argument that his actions were protected under presidential authority.

In his latest attempt to depict President Joe Biden as an authoritarian, Donald Trump turned to the words of Vladimir Putin at a rally in Durham, New Hampshire.
At the rally, Trump quoted Putin, “Even Vladimir Putin … says that Biden’s, and this is a quote, politically motivated persecution of his political rival is very good for Russia because it shows the rottenness of the American political system, which cannot pretend to teach others about democracy.”
Trump also took pride in the praise he received from Viktor Orbán, the authoritarian prime minister of Hungary, who referred to Trump as the savior of the Western world.
Trump further mentioned his amicable relationship with Kim Jong Un, the North Korean dictator, and stated that Kim has a favorable view of him despite his disapproval of the current administration.

Donald Trump claimed that he was merely doing his “duty” as president by alleging that the 2020 election was “rigged” and “stolen,” therefore believes he deserves “immunity” from prosecution.
“I wasn’t campaigning, the Election was over. I was doing my duty as President to expose and further investigate a Rigged and Stolen Election. It was my obligation to do so, and the proof found is voluminous and irrefutable,” the former president wrote in a Truth Social post Sunday morning. “Therefore, among other reasons, of course I am entitled to Immunity.

The Supreme Court has denied a petition from Special Counsel Jack Smith to fast-track a ruling on whether former President Donald Trump is immune from criminal prosecution for any crimes he committed while in office. The single-sentence rejection, released on Friday, contained no explanation of the court’s reasoning.

A federal judge ruled on December 19 that Rep. Scott Perry (R-Pennsylvania) must hand over the 1,659 messages to federal investigators.
The judge found that the communication records had not been protected by the “speech and debate” clause of the U.S. Constitution.
This court order is the most recent twist in the investigation of the January 6 Capitol riots which has made its way through courts for months and implicated Perry.
His phone was seized by the FBI in late 2022 as part of the federal investigation into the efforts to interfere with the 2020 election’s certification.
This happened before Jack Smith had been appointed special counsel.
The investigators sought out a second warrant so that they could access Perry’s data. But they had to wait after Perry claimed protection under the Constitution’s “speech and debate” clause for more than 2,219 records.

Donald Trump can still be restricted in what he says witnesses as well as lawyers and court staff, and their families, in his federal election conspiracy case, an appellate court ruled on Friday.
The three-judge panel largely upheld Judge Tanya Chutkan’s gag order in the proceedings, with the exception that the restrictions do not apply to Special Counsel Jack Smith, a frequent Trump target who he has labeled “deranged.”
The judges also set parameters for the type of restrictions on Trump’s comments about attorneys and court staffers, writing that it applied in cases where his statements “are made with the intent to materially interfere with, or to cause others to materially interfere with, counsel’s or staff’s work in this criminal case, or with the knowledge that such interference is highly likely to result.”

Georgia prosecutors have added former Vice President Mike Pence to the list of witnesses who could be called to testify in Donald Trump’s upcoming election interference Rico trial, according to a report from CNN.
More than 150 individuals, including Pence, have reportedly been included in the Fulton County witness list, which remains under seal.
While Pence was compelled by Special Counsel Jack Smith to testify before a grand jury in the Justice Department’s federal election interference case against Trump, the former vice president has so far skirted significant involvement in the Fulton County case.

Former Vice President Mike Pence reportedly considered former President Donald Trump‘s advice to skip the electoral certification of the presidential election, which he presided over in January 2021 and certified the 2020 election.
In February, Special Counsel Jack Smith’s office issued a subpoena to Pence, which prompted the former vice president to participate in interviews where he revealed information from handwritten notes he had taken.
In Pence’s notes taken in December 2020, before the January 6 Capitol riot, he had written, “Not feeling like I should attend electoral count,” because of “too many questions, too many doubts.” He wrote it would be “too hurtful to my friend. Therefore I’m not going to participate in certification of election.”
On Christmas Eve of 2020, Pence made a notation that suggested he would step aside and allow the Senate’s President Pro Tempore, Trump loyalist Sen. Chuck Grassley (R-Iowa), to assume his position for the electoral certification process.

Update: NBCUniversal argued that a federal rule does not impose an “an impregnable ban” on audio and video coverage of former President Donald Trump’s upcoming criminal trial on election conspiracy charges.
In a filing today, NBCU’s legal team, led by Theodore Boutrous, wrote, “Although the government argues that settled law forecloses this kind of coverage, that is incorrect.
