Less than 1 year after this episode first aired, British au-pair Louise Woodward was arrested in Newton, Massachusetts, over the death of 8-month old Matthew Eappen. As in this episode, Woodward had received very little training from the agency that employed her. She was convicted of second-degree murder before having her conviction reduced to involuntary manslaughter.
This episode appears to be based on the 1991-1992 Olivia Riner case, which is actually referenced by Schiff. Riner, a Swiss au pair, was accused by the parents of 3-month Kristie Fischer of causing the death of the infant, who died in a house fire in Thornwood, New York on December 1, 1991. Riner was found not guilty at trial because the prosecution had not provided a motive for why Riner would have started the fire.
When Briscoe and Curtis got permission from the Karmels to search the nanny Lila Crenshaw's room Brisco read aloud a portion of her diary with the words ''..........let them clean his dirty nappies just once then let's see how much they love their precious little bundle''. Although Lila Crenshaw is supposed to be British (she's American actress) the screenwriters were spot on using the word 'nappies' because in Britain a nappy is our word for a diaper.
