The missing tape is found as Julie and Richard Cross decide that they should help out. Julie finally finds a conscience and Cross decides that he has a little one also (since he is dying he figures he's got nothing to lose). Turns out that the real culprit (I won't say who!) basically blackmailed Cross into setting up Neil and the rest of the episode shows how.
When the tape is shown to the ADA and the judge, the Assistant DA actually asks why the tape was not shown as evidence earlier! Why would the defense EVER hold back a tape like that when it could have exonerated their client? Just doesn't make sense to me.
All ends sort of happily except that Ted tries to get back with his horrid ex-wife! I hope that does not happen.
