To begin with, I offer my sympathy to Ryan Dunn's family and friends, and to those of Zachary Hartwell, who also died in the crash. I mean that sincerely. It is tragic to lose a loved one. I also regret that my tweet about the event was considered cruel. It was not intended as cruel. It was intended as true.
I have no way of knowing if Ryan Dunn was drunk at the time of his death. What I knew before posting my tweet was that not long before his death, he posted...

"Jackass" daredevil Ryan Dunn wasn't alone when he crashed his Porsche early Monday (June 20) morning. Authorities now say 30-year-old Zachary Hartwell (above right) was also killed in the accident, reports TMZ.com.
Dunn, according to police, was driving in excess of 100 mph when he lost control of his Porsche and it flew off a rural Pennsylvania road, crashed into a tree and exploded in a ball of fire.
Hartwell, a production assistant on "Jackass 2" who also had a part in Bam Margera's movie "Minghags," appeared in photos Dunn tweeted just hours before the crash. In the pictures, taken inside a Philadelphia area bar, the two appear to be drinking.

Roger Ebert's comments aside, a new progress is reported on the accident that killed "Jackass" star Ryan Dunn on Monday, June 20 morning. The person on the passenger seat when Dunn skidded his Porsche off the road outside Philadelphia is 30-year-old Zachary Hartwell of West Chester, Pennsylvania.
Hartwell is not a member of the "Jackass" crew but he was credited as production assistant in "Jackass: Number Two". According to MTV, Hartwell is a recently married Iraq war veteran who is also a "car stunt driver" in Bam Margera's 2009 movie "Minghags".
Dunn's car went off the road, flipped over a guardrail and crashed into the woods before bursting into flames. He and Hartwell were killed on the spot and police could identify Dunn through his tattoos. It is still argued whether alcohol contributed to the crash because speed may have been the one factor.
The crash victims indeed downed...

Police have identified Zachary Hartwell as the passenger who was killed in a car crash along with "Jackass" star Ryan Dunn. Hartwell, 30, appeared drinking with Dunn in a photograph Dunn tweeted hours before the crash (left; Hartwell is on the right in the photo, opposite Dunn). Dunn, 34, was driving his Porsche when it jumped a guard rail and burst into flames. Hartwell was credited as a stunt driver in "Minghags," a 2009 film co-directed by Dunn's friend and "Jackass" cohort Bam Margera.
